ZoTracker Terms and Conditions

These terms explain the rules for using the ZoTracker website, public signup flow, and web-based tracking and compliance platform.

1. Agreement to these terms

These Terms and Conditions govern access to and use of ZoTracker websites, public forms, account signup, and the ZoTracker web application. By using ZoTracker, creating an account, submitting a form, or accessing the service on behalf of an organization, you agree to these terms.

2. Who provides ZoTracker

ZoTracker is provided by ZoTracker Data Services Inc., a Canadian company based in British Columbia. References to "ZoTracker," "we," "us," and "our" mean ZoTracker Data Services Inc. References to "you" mean the person or organization using the service.

3. Account eligibility and authority

You must be at least the age of majority in your jurisdiction to create or administer an account. If you use ZoTracker for a company or other organization, you confirm that you have authority to accept these terms for that organization.

4. The service

ZoTracker is a web-based tracking and compliance platform. It helps teams organize records such as certificates, orientations, forms, incidents, equipment, contractors, employees, projects, customers, documents, tasks, reminders, reports, and related proof. Available features, limits, storage, support, and modules may vary by plan, account configuration, and product updates.

5. Account responsibilities

You are responsible for keeping account information accurate, protecting login credentials, assigning access only to authorized users, and reviewing user access when roles change. You are also responsible for the records, files, and information submitted by your organization and its users.

6. Acceptable use

You agree not to misuse ZoTracker. This includes attempting unauthorized access, disrupting the service, bypassing security controls, uploading unlawful or harmful content, infringing third-party rights, using the service for fraudulent activity, or interfering with another customer's use of ZoTracker.

7. Customer data and content

Your organization retains ownership of the business records and files it uploads to ZoTracker. You grant ZoTracker a limited right to host, process, transmit, back up, display, and otherwise use that content only as needed to provide, support, secure, and improve the service.

8. Privacy and personal information

ZoTracker handles personal information according to the ZoTracker Privacy Policy. The Privacy Policy explains what information may be collected, why it is used, how service providers may support the service, and how to contact us with privacy questions.

9. Plans, billing, and renewals

ZoTracker may offer a permanent Basic Free plan and paid subscription plans. Paid subscriptions, add-ons, taxes, renewal timing, payment handling, cancellation requests, and account limits are described in the product, pricing page, subscription area, invoice, or order process where applicable. Unless otherwise stated, fees are billed in advance and may be non-refundable except where required by law or expressly agreed in writing.

10. Free plan and trial-style use

Basic Free is intended to help small teams start with real records within published limits. ZoTracker may change plan limits, features, or eligibility for new accounts over time. Existing account changes will be handled according to the product notices, subscription terms, or direct communication provided to affected customers.

11. Support and product changes

ZoTracker may update, improve, add, or remove features from time to time. We aim to keep the service practical and reliable, but we do not guarantee that every feature will remain unchanged. Support availability may vary by plan and account type.

12. Third-party services

ZoTracker may use third-party service providers for hosting, payment processing, analytics, communication, security, support, or other operational needs. Third-party services may have their own terms and privacy practices.

13. Service availability and security

We work to provide a reliable and secure service, but no online service can be guaranteed to be uninterrupted, error-free, or completely secure. You are responsible for maintaining your own appropriate backups, exports, internal controls, and business continuity practices.

14. Intellectual property

ZoTracker owns or licenses the software, website content, design, trademarks, logos, documentation, and other materials that make up the service. These terms do not transfer ownership of ZoTracker intellectual property to you.

15. Suspension or termination

ZoTracker may suspend or terminate access if an account violates these terms, creates security risk, fails to pay required fees, misuses the service, or if continued access would create legal, operational, or safety concerns. You may stop using ZoTracker or request cancellation according to the subscription and account options available to you.

16. Disclaimers

ZoTracker is provided on an "as is" and "as available" basis to the fullest extent permitted by law. ZoTracker helps organize records and workflows, but it does not replace professional legal, safety, regulatory, insurance, accounting, or compliance advice. Your organization remains responsible for deciding what records are required and whether its processes meet applicable obligations.

17. Limitation of liability

To the fullest extent permitted by law, ZoTracker will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunity. Where liability cannot be excluded, ZoTracker's total liability will be limited to the amount paid for the service during the twelve months before the event giving rise to the claim, or CAD $100 if no paid subscription applied.

18. Governing law

These terms are governed by the laws of British Columbia and the laws of Canada that apply there, unless another written agreement with ZoTracker states otherwise.

19. Changes to these terms

ZoTracker may update these terms from time to time. The updated version will be posted on this page with a revised date. Continued use of ZoTracker after the updated terms are posted means you accept the updated terms.
